  • Any person who intends to bid at the auction, must register prior to the commencement of the auction. FICA documents will be required for auction registration
  • S.T.C means subject to confirmation – please check your invoice properly before removing any items as some prices on items need to be confirmed first with the seller before the sale can take place.
  • The auctioneer will only accept bids from registered bidders. No potential buyers may bid without a buyers card.
  • The Auctioneer shall be entitled to bid on behalf of the seller or to an amount which is less than the reserve price.
  • The Auctioneer reserves the right to regulate the bidding and to alter or withdraw any lot or vary order of same.


  • PLEASE NOTE: All items are sold “voetstoots”, (as is), therefore viewing is essential on viewing days, no warranty or guarantee is given or implied nor will any refunds be issued or repairs done. It is the responsibility of the buyer to view and inspect items on viewing days in order to determine whether or not they are happy to purchase the item in its current condition. 
  • Buyers are deemed to have made themselves acquainted with the lot or lots they bid on.


  • PLEASE NOTE: We as an auction house only facilitate the sale of goods between  the Buyer and Seller and as such we rely on the description and history provided by the seller. While we do make every additional effort to research, inspect and verify items before sale we cannot be held liable for any error or omissions in the items description or condition. Any errors or omissions would not be intended by Durbanville Auction House. All information and descriptions given out verbally or through advertising are given in good faith.


  • The Auctioneer’s venue roll and decision is final and no dispute will be taken into consideration or correctness of same. The Auctioneer is entitled to correct any error in the conclusion of any sale. If the Auctioneer or Seller makes any mistakes during the selling process, such mistakes shall not be binding upon either parties, yet however, shall be rectified.
  • Any prospective bidder must read the Terms and Conditions of the Auction and must not bid unless he or she has done so.
  • Over and above the purchase price, the Purchaser is responsible for the payment of the 17% Auctioneers Commission on the fall of the hammer.
  • The highest bidder shall be declared the Purchaser and if any dispute arises, it is at the discretion of the Auctioneer whether to put the lot up for auction again.


  • PLEASE NOTE: ALL SALES ARE FINAL. Once a lot has been awarded to the Purchaser they are now liable to pay the hammer amount plus the Auctioneers Commission for said lot. No cancellations will be made nor will any items be reauctioned on behalf of the Purchaser.
  • On the fall of the hammer, risk in each item passes to the purchaser.
  • The purchaser will pay the purchase price on each item by Immediate EFT, Cash or Card. EFT proof of payments to be sent to 0827722901 and confirmed at the office before the removal of goods.
  • No items shall be removed from the auction floor during the time of sale or prior to full payment made by the Purchaser. The Purchaser will be responsible for the removal of his or her goods and for any damages to the building or other items while removing goods.
  • Ownership shall pass to the Purchaser only on payment of the full purchase price, plus the Auctioneers Commission as well as any bank charges incurred.


  • PLEASE NOTE: The Purchaser is Not permitted to leave items on site to be reauctioned or dumped on their behalf. The Purchaser will be held liable for any dumping costs incurred and will be expected to pay this amount in full before being permitted to participate in future auctions.
  • All goods purchased must be removed immediately after the sale or by such time as announced by the Auctioneer. The Auctioneer will only store the items after a written agreement is made between the Auctioneer and the Purchaser. This will be at the expense of the Purchaser.
  • All goods must be removed within 3 days of the auction. Goods paid for but not collected within 7 days will incur storage charges. The amount charged will be decided at the discretion of the Auctioneer/Owner based on the quantity of and storage space occupied by the goods. 
  • The Buyer will forfeit ownership to goods paid for if not collected within 14 days of purchase and shall have no claim whatsoever against Durbanville Auction House.
  • If the purchaser fails to carry out any of his obligations under the conditions of sale, the items may be put up for sale again and the Purchaser shall be responsible for any loss sustained by reason of his default.
  • Vehicle Registration Papers (Natis) delays maybe experienced from time to time and is out of our control. We do our utmost to resolve delays as quickly as possible. No cancellations are permitted on account of document delays
  • Please register or dealer stock your vehicles immediately after the auction to avoid complications. 
  • Durbanville Auction House will not be responsible or neither entertain the resolution of any problems experienced by the buyer if he/she did not register the vehicle immediately after the auction.
  • Durbanville Auction House does not guarantee any mileages or year model displayed on the vehicles. Vehicles are sold as is No Duty to Repair.
  • Invoices must be paid in full within 24 hours if not goods purchased will be deemed not sold and the sale will be cancelled
  • Durbanville Auction House reserves the right to prohibit individuals from participating in future auctions if they do not adhere to the terms and conditions stated above.


  

  •  The highest accepted bidder shall be the purchaser
  • The auctioneer has the right to regulate the bidding. He may furthermore withdraw any item at any time
  • The auctioneer/owner does not hold himself responsible for any errors of description. A bid shall be taken as proof that the bidder has made himself/herself acquainted with the conditions of lots for which he/she bids
  • All goods are sold voetstoots (as is). Items are not guaranteed, returnable or refundable.
  • Lots once knocked down remain at risk of the purchaser
  • No goods may be removed until paid for. Payment must be made on the day of purchase and reflect within 24 hours.
  • No sales will be netted off against purchases, if you have purchased items on auction payment will be due at the conclusion of the auction regardless of whether or not the Purchaser has also sold on auction. This allows our recon and auditing process to run smoothly.
  • Should the buyer have items up for auction they are Not permitted to bid up said items. Any Buyers or Sellers who do so will risk being prohibited from participating in future auction.
  • Any Buyer found to be intentionally attempting to 'rig', 'fix', 'manipulate' or otherwise fraudulently/illegally influence the outcome of the auction will be prohibited from participating in future auctions.
  • The Buyer is not permitted to leave purchased items on site to be reauctioned or dumped on their behalf. Those who do so will be held liable for any dumping costs incurred by Durbanville Auction House.
  • Items purchased must be removed within 3 days of the auction.

  • Terms: CASH, EFT(Internet), DEBIT/CREDIT CARD
  • ALL SALES ARE FINAL. Once a lot is awarded to the Buyer he/she will be held liable to pay the hammer price plus the buyers commission. There will be NO CANCELLATIONS
  • 2% Levy of Credit Card and Debit Card Payments
  • 17% Buyers Commission (Unless otherwise agreed with management)
  • Durbanville Auction House reserves the right to prohibit individuals that do not adhere to the above conditions from participating in future auctions.


  

  • All sellers must fill-in and sign a sellers forms and make themselves familiar with the terms therein. The form must be submitted to management on the day of delivery/collection. No items will be accepted without completed paperwork.
  • Whereas the seller desires to auction goods for the purpose of facilitating a sale. Successful auction fees are at 18% which will be levied on the final hammer price.
  • The seller hereby indemnifies Durbanville Auction House against any claim of whatever nature for losses or damages sustained as a result of the loss, destruction or damage of article(s) hereby pledged due to ‘Acts of God”, theft, fire, transportation, moving, storage or any other reason beyond the control of Durbanville Auction House.
  • Payment to the seller for property sold will be due within 15 working days of the sale, 2-3 weeks.
  • The seller declares that he/she is the legal owner of the article(s) aforementioned, that the article(s) is/are fully paid for and that no other legal entity or person has any right, title or interests in the article(s). The seller further declares that he/she is legally entitled to deal freely with the articles.
  • Storage and transport of goods remains at the risk of the seller until the sale is concluded. Should the items not be sold it can be entered into auction a second time only, after which the seller is responsible for the removal of the property from the auction house. No deliveries will be made. The seller will be given 7 days to remove their property after which storage fees will be charged. Items not removed within 
  • Any items entered into auction first need to be approved by management as acceptable for auction. Please do not drop off any goods without first clearing the items with management. The condition of the item must be disclosed. Any items dropped off without permission and deemed unfit for auction (broken, damaged or unsellable) will be dumped and a dumping fee will be charged to the sellers account.
  • Should the seller require that their items be collected for auction a transport fee will be levied at the discretion of the Auction House owner (depending on distance and quantity). 
  • Items collected which the seller desires to withdraw prior to auction can only be withdrawn from auction upon the payment of a release fee which will amount to the total costs of collection plus any relevant admin costs.
  • All reserves must be discussed with management on the day of delivery/collection; we will not accept any items with reserves that are not attainable at auction.
  •  All reserves must be given in writing on the official form provided on the day the items are delivered/collected . No verbal reserves will be accepted and no reserves may be altered or added after forms have been submitted.
  • Should the Seller also wish to purchase on auction he/she is Not permitted to place bids on items he/she is the seller of. Any Buyers or Sellers who do so will risk being prohibited from participating in future auction.
  • Any Seller found to be intentionally attempting to 'rig', 'fix', 'manipulate' or otherwise fraudulently/illegally influence the outcome of the auction will be prohibited from participating in future auctions.
  • No sales will be netted off against purchases, if you have purchased items on auction payment will be due at the conclusion of the auction regardless of whether or not the Purchaser has also sold on auction. This allows our recon and auditing process to run smoothly.
  • Durbanville Auction House reserves the right to prohibit individuals that do not adhere to the above conditions from submitting goods to future auctions.


  

Durbanville Auction House will use reasonable efforts to ensure that any information, provided by the customer/client, is stored in a secure manner. The information will be processed and kept for the purpose of normal business activities and record keeping according to the SAPS rules/regulations for second hand dealers. The customer indemnifies Hennie Engelbrecht and Durbanville Auction House from any unintentional disclosure of such information to unauthorised persons. The buyer hereby consents to his/her information being stored and used in connection with his/her dealings with Durbanville Auction House.
